Terms of Use for Connect

1. Introduction
   • Purpose: These Terms of Use (ToU) govern the use of the Connect platform, owned by Technologies Ilema Inc., located at 4160 Rue du Barrage, G6X 1H2, Lévis, Québec, Canada. Connect enables businesses to send messages to their customers via the WhatsApp Business API.
   • Acceptance of Terms: By using Connect, you unconditionally accept these ToU.
2. Definitions
   • • User: Any individual or entity using the Connect platform.
     • Service: The Connect platform and all associated features that allow for message sending via the WhatsApp Business API.

    

3. Access to the Service
   • • Access Conditions: Access to Connect is reserved for duly registered businesses that have subscribed to a usage license. Users must be at least 18 years old.
     • Availability: Technologies Ilema Inc. strives to ensure Connect is accessible 24/7, except during maintenance or force majeure.

    

4. Use of the Service
   • • Compliance: Users agree to use Connect in accordance with applicable laws and these ToU. Using the service for illegal, fraudulent, or harmful purposes is prohibited.
     • User Responsibilities: Users are responsible for the accuracy of the information they send via Connect and must ensure they have the necessary rights to communicate with the message recipients.

    

5. Intellectual Property
   • • Content: Connect and all its components (software, texts, images, logos, etc.) are the exclusive property of Technologies Ilema Inc.
     • Usage License: Technologies Ilema Inc. grants users a non-exclusive, non-transferable license to use Connect in accordance with these ToU.

    

6. Protection of Personal Data
   • • Collection and Processing: Technologies Ilema Inc. collects and processes personal data in accordance with its Privacy Policy, available on the platform.
     • User Rights: Users have the right to access, rectify, and delete their personal data. To exercise these rights, they can contact Technologies Ilema Inc. at contact@ilematech.com.

    

7. Limitation of Liability
   • • Provider Liability: Technologies Ilema Inc. cannot be held liable for direct or indirect damages resulting from the use or inability to use Connect, except in cases of gross negligence or intentional fault.
     • Force Majeure: Technologies Ilema Inc. cannot be held responsible in case of force majeure preventing the execution of services.

    

8. Modifications to the ToU
   • • Notification of Changes: Technologies Ilema Inc. reserves the right to modify these ToU at any time. Users will be informed of changes via email or through a notification on the platform. Continued use of Connect after notification constitutes acceptance of the new ToU.

    

9. Governing Law and Jurisdiction
   • • Governing Law: These ToU are governed by the laws of the province of Quebec, Canada.
     • Competent Jurisdiction: Any dispute related to the interpretation or execution of these ToU will be subject to the exclusive jurisdiction of the courts of Quebec, Canada.
